HOLIDAY
CONTRACT
To secure a booking we require a completed booking form and the necessary
deposit or full payment. Clients booking by telephone or facsimile will be
deemed to have read the booking conditions and to have agreed the Declaration
on the booking form.
DEPOSITS AND BALANCE PAYMENT
A deposit of RM 500.00 or 20% of the tour costs, whichever is greater will be
required upon booking. At our absolute discretion we may vary the quantum of
the deposit for bookings made during peak period and/or to special
destinations.
The balance of all monies due, including any surcharges applicable at that
time, must be paid to us not later than 21 days before departure. If the
balance is not paid on time we may cancel your booking and apply the
cancellation charges set out in the paragraph headed CANCELLATION CHARGES.
LATE BOOKINGS
For bookings made less than 21 days before departure full payment must be made
immediately before travel documents can be processed. EXTENSION OF STAY
Extension of stay after the end of the tour is permitted subject to the maximum
ticket validity. Such extension will be at your own expenses and must be
arranged prior to departure. Transfers between hotel and airport on the last
day will not be provided.
AMENDMENT OF NAMES
Amendment to the names must be notified to us writing at least 14 days before
the departure date. The amendment is subject to approval by the airlines. A
documentation fee of RM 150.00 will be charged.
TOUR LEADER
We will provide the services of an accompanying tour leader for a group of
minimum of 15 adult passengers.
CANCELLATION CHARGES
Upon receipt of written notice of cancellation, cancellation charges will be
imposed as follows:
More than 21 days before departure RM 300.00
21 to 15 days before departure RM 500.00
14 to 07 days before departure 50% of the total tour cost
Less than 7 days before departure 100% of the tour cost
Note: Any cancellation for booking for departure during the peak season e.g.
Chinese New Year, a surcharge of RM 200 will be imposed.
DELAYS/FLIGHTS
The timing of air, sea, road or rail departures are estimates only. We cannot
be held liable or accept any liability for any delay on your flight whether the
cancellation or delay is caused by adverse weather conditions, rescheduling by
an airline, airport authority, and/or action by air traffic controllers,
mechanical breakdown or industrial action. Where long flight delays result in
lost holiday time, no refund are given by hotels or supplies. Similarly,
airlines do not offer compensation for flight delays.
ALTERATION OR CANCELLATION BY US
While we will use our best endeavors to operate all tours as advertised, we
reserve the right to change any of the facilities, services, prices or
itineraries described therefore no compensation will be paid for alterations or
cancellations caused by changes or cancellations to schedules by airlines, the
number of persons who have booked is less than that required for the tour
package of any “Force Majeure? “Force majeure?includes (but are not limited
to) war, threat of war, riot, civil disobedience or strife industrial dispute,
terrorist activity, natural or nuclear disaster, fire, adverse weather
conditions, epidemics or health risks, level of water in rivers, technical or
maintenance problems with transport, closed or congested airports or ports,
unforeseen operational decisions of air carriers such as changes of schedules
or cancellation of flights, or any unforeseen or unavoidable event beyond our
control. For any tour, we reserve the right to change air carries and in such
event no compensation is payable. We reserve the right to cancel a tour in any
circumstances.
MINIMUM NUMBERS
Each tour is dependent upon a minimum number of persons participating. All our
tours require a minimum number of bookings before they will operate. Should we
cancel the tour because of insufficient number, we will refund all monies paid
without further obligation or liabilities on our part and no compensation will
be payable.
HOLIDAY
PARTICIPATION
You agree to accept the authority and decision of the Company’s employees, tour
leaders and agents whilst on tour with the Company. If the opinion of such
person your conduct during the to appears likely to endanger the safe,
comfortable or happy progress of the tour, you may be excluded from all or part
of the tour. Should this happen to you we cannot be held liable in any way. The
person signing the booking form warrants that he/she has full authority to do
so on behalf of all persons whose names appear thereon, and confirms that all
such persons are fully aware of and accept these conditions.
COMPLAINTS
should you have a complaint about any of the tour agreements, you must tell
both the relevant supplier and our representative at that time. It is only if
the relevant supplier and we know about the problems that there will be an
opportunity to put things right. Failure to complain on the spot will result in
your ability to claim compensation being extinguished or at least reduced.
PASSPORT, VISAS, AND HEALTH
REQUIREMENTS
It is your responsibility to ensure that you satisfy all applicable
requirements and take with you all necessary documentation for the whole
journey. We cannot be held liable if you fail to do this or be held responsible
for any denial of boarding or entry into a destination due to improper
documentation or whatever reasons and, if we suffer any loss of expense of such
failure on your part, you will be obliged to reimburse us.
ACTING AS AGENT ONLY
We act only as an agent for carriers, transportation companies, hotels and
other suppliers and will not be responsible for any losses, damages, accidents,
changes in the schedule or other irregularities caused or arising from
circumstances beyond our control and have no liability for any death, personal
injury or loss of whatever nature you may suffer.
TRAVEL INSURANCE
As you together with your personal property including baggage are at all times
solely at your own risk, we bly recommend adequate travel insurance. You should
satisfy yourself that any travel insurance arranged through us is what you
require and should arrange supplementary insurance if need be.
TOUR COSTS
No refund or reduction will be made to you with regard to air ticket, meals,
accommodation, sightseeing, transfers or any other services which are included
in the tour costs but not utilized, fully or partially by you for whatever
reasons.
